Business Community Confidence in Courts of Arbitration and Evaluation of Arbitration Judicial System

The paper is based on the data of two waves of top officials and chief lawyers’ surveys at more than 1600 enterprises in Russia carried out by Levada Center in 2010 and 2011. The data showed a considerable level of respondents’ confidence in Higher Arbitration Court, as well as in Arbitration Courts in regions, areas, Republics. The level of confidence depends on the experience of participation in law-suits and on how, in business community opinion, the courts work quality is evaluated (objectivity, professionalism in the consideration of a case), the level of their independence or corruptness. There is no unanimity in the opinion on whether an independent and effective system of Arbitration Courts has established in Russia during recent 20 years, a more positive attitude being expressed by lawyers and those enterprises representatives who have got an experience of solving controversial issues in the Court. But views on the main drawbacks of
contemporary Arbitration Courts system are stable enough. The principal of them are dependence of courts on the authorities of various levels;
corruptness, bribery; formalism, nonobjective consideration of cases.
